The FCC has really gotten lax in the past 10 yrs with "general public" enforcement, check out their web site for their enforcement log. It's almost funny how much they let people get away with before hitting them up with fines. I'd personally prefer the old approach of "show up out of nowhere, confiscate equipment, and start writing fines". An old transmitter that's kicking out nasty harmonics or bleeding across channels is a hazard to any heli in the air on the same band.So, it's the big guys with the helis planted in the ground, rolling up their sleeves and slowly walking toward you that you should be thinking about.
